TOURS, ATTRACTIONS & THIRD-PARTY BOOKINGS
Customer Terms
These Tours, Attractions & Third-Party Bookings Terms apply only if you book, purchase, or participate in a tour, attraction, experience, or activity provided by an independent third-party operator and listed on the What’s On Aotearoa platform.
They apply in addition to the General Terms & Conditions available at:

1. Platform Role (Critical Clarification)
What’s On Aotearoa operates as a digital discovery, listing, and booking facilitation platform.
Unless expressly stated otherwise:

What’s On Aotearoa is not the tour operator, attraction provider, or activity host
-
Experiences are delivered by independent third-party businesses
-
What’s On Aotearoa does not own, control, or manage physical locations
-
What’s On Aotearoa does not control on-site operations, safety procedures, staffing, equipment, or facilities
When you make a booking, a contract is formed directly between you and the third-party provider, even if payment is processed through the platform.
What’s On Aotearoa acts solely as an intermediary facilitating listing visibility and, where enabled, payment processing.
2. Bookings & Payments
Where bookings are facilitated through the platform:

Payment may be collected by What’s On Aotearoa on behalf of the provider

Booking confirmation details are issued at the time of purchase

The provider is solely responsible for delivering the booked experience
What’s On Aotearoa does not guarantee:
-
Ongoing availability beyond confirmed bookings
-
That experiences will meet subjective expectations
-
That providers will not modify operational details where reasonably necessary
All operational and delivery obligations rest with the provider.
3. Pricing, Fees & Commission Disclosure
What’s On Aotearoa may receive:

A commission from providers for bookings made through the platform

A facilitation or service fee
-
Transaction or processing fees (where disclosed at checkout)
Displayed pricing may include commission or fees, or such amounts may be separately disclosed during checkout.
Commission arrangements do not alter your rights under applicable New Zealand consumer protection law.
4. Provider Terms & Conditions
Third-party providers may have their own:

Safety requirements
-
Participation waivers
-
Cancellation and refund policies
By booking an experience, you agree to comply with the applicable provider terms in addition to these platform terms.
Where provider terms relate to operational delivery of the experience, those terms govern.
Where mandatory New Zealand consumer law applies, that law prevails.
5. Cancellations, Changes & Refunds
Cancellations, changes, and refunds are primarily governed by the third-party provider’s policies.
What’s On Aotearoa:

Does not independently guarantee refunds

Does not control provider cancellation decisions

May assist with communication between customer and provider where reasonable
Where payment has been processed through the platform, any refund authorised by the provider may be returned via the original payment method.
Nothing in this section limits your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand law.
6. Self-Guided & Outdoor Experiences
Some listed experiences may be:

Self-guided

Conducted in outdoor or variable environments
Where an experience is self-guided or involves environmental risks:

You remain responsible for your own safety and decisions

7. Information Accuracy and Content Use
Information displayed on the platform, including descriptions, images, schedules, inclusions, availability indicators, and pricing, may be based on provider-supplied material and publicly available information.
While reasonable care is taken, What’s On Aotearoa does not warrant:

Accuracy

Completeness
-
Ongoing availability
-
That operational details will remain unchanged
You are responsible for confirming any details material to your decision directly with the provider.
All platform content, including listings, text, images, layout, and related materials, remains subject to applicable rights owned by us and/or our licensors, providers, contributors, or other relevant rights holders.
Unless expressly permitted by us in writing, you must not copy, reproduce, republish, scrape, harvest, crawl, download, frame, mirror, extract, distribute, or otherwise reuse platform content for commercial purposes or for republication on another website, platform, service, database, or publication.
You must not use any automated means, including bots, scripts, scrapers, spiders, crawlers, data mining tools, or similar technologies, to access, extract, collect, index, monitor, or reuse any content or data from this platform without our prior written consent.
We may restrict, suspend, or block access to any person, account, IP address, system, or service that we reasonably believe is misusing the platform or its content, including through unauthorised automated access, copying, extraction, scraping, or republication.
8. Health, Safety & Participation
Third-party providers are responsible for:

Health and safety compliance

Staff qualifications and supervision

Equipment standards
-
On-site risk management
You are responsible for:

Assessing your own suitability to participate

Disclosing relevant health conditions where required

Following provider instructions and safety guidance
Failure to comply with provider requirements may result in refusal of participation without refund, subject to the provider’s policies.
9. Limitation of Liability
To the maximum extent permitted by New Zealand law:
What’s On Aotearoa is not liable for:

Acts or omissions of third-party providers
-
Personal injury, death, property damage, or loss occurring during an experience
-
Cancellations caused by weather, operational issues, or provider decisions
-
Indirect, consequential, or economic loss
Where liability cannot be excluded under New Zealand law, liability is limited to the amount paid by you for the booking made through the platform.
Nothing in these terms excludes liability where exclusion is not permitted by law.
10. Governing Law
These Tours, Attractions & Third-Party Bookings Terms are governed by the laws of New Zealand.
