Audio Tours & Digital Content

These terms apply when you purchase or access an audio tour or other digital content identified as supplied by What’s On Aotearoa. They apply with our General Terms & Conditions and Refund Policy. The description and access conditions shown for the particular digital product before purchase also form part of its terms. If an independent provider supplies a different product through the platform, the terms displayed for that offer apply.

1. What You Are Buying

An audio tour is educational digital content for independent use. Unless its description expressly says otherwise, purchase does not include an in-person guide, admission to a site, a guided activity, land access permission, transport, on-site assistance or emergency support. You may listen without visiting a location. If you choose to visit, the visit is self-guided; we do not monitor your location or supervise your actions.

We supply the digital content described in our offer and are responsible for our own content, descriptions and digital delivery to the extent required by law. We do not own or maintain a physical location merely because the content discusses or depicts it.

2. Before Visiting a Location

Outdoor, coastal, rural and urban conditions can change. Before and during a visit, check relevant current weather, tides, access notices, opening hours, route conditions and official warnings. Follow signs and lawful directions; do not enter closed or private land without permission. If conditions appear unsafe, stop or choose another time. A recording or map does not override a current closure or safety notice.

Any location-specific warnings made available with the product should also be read and followed. We take reasonable care with our content, but cannot continuously inspect or guarantee changing land, weather or access conditions.

3. Directions & Land Access

Directions, maps, timings and descriptions are intended to help you understand the subject of the tour and the route described when the content was prepared. They are not a grant of access or a promise that a place remains open or unchanged at the time you visit. We will take reasonable care in preparing and correcting our own material. Please tell us if a route, access instruction or material warning appears inaccurate so we can investigate.

If access to a location essential to a paid tour is unavailable or materially different from what was represented when you purchased it, contact us. We will assess the correction, alternative access or remedy available under the offer and applicable law. We will not require you to trespass to use the content.

4. Digital Access & Technical Requirements

The product description should tell you whether content is streamed, downloaded or accessed by link or QR code, identify any material device or connectivity requirements, and state any time limit on access before purchase. You are responsible for ordinary mobile data charges and for using a device safely, including avoiding distraction while moving through a hazardous area.

Temporary outages, device problems or platform changes can occur. If the content we supplied does not work as described, contact us so we can investigate and restore access, provide another working means of access, or offer the remedy required by law. We will not remove purchased access or materially reduce the paid content without addressing the resulting rights under the purchase terms and applicable law.

5. Changes to Content

We may make corrections and updates to improve accuracy, accessibility or quality, or respond to changed access conditions, rights issues or legal requirements. An update may change a recording or route description. If we withdraw or materially change paid content in a way that prevents you receiving what was purchased, we will offer an appropriate remedy under the terms and applicable law. We do not promise that an earlier version will remain available indefinitely.

6. Cancellations & Refunds

If you change your mind after digital access or a download has been supplied as described, a refund is not automatic. A request made before access is supplied will be considered under the offer’s disclosed cancellation terms and applicable law. If content is faulty, unavailable, materially different from its description, or cannot be accessed using the requirements we disclosed, contact us for a remedy. 7. Ownership & Permitted Use

Audio, scripts, images, design, branding and related material are protected by intellectual property rights held by us and/or the relevant creators, cultural contributors, licensors or other rights holders. Purchase gives you a non-exclusive licence to access and use the supplied content for your own personal, non-commercial enjoyment within the access period disclosed for that product, if any. It does not transfer ownership or rights to redistribute the material.

Except as allowed by law or with the relevant rights holder’s permission, do not resell, publicly perform, publish, share access credentials or files, or commercially reproduce or adapt the content. Technical copies reasonably needed for authorised playback are permitted. We may suspend access where we reasonably identify unauthorised redistribution or other serious misuse; we will take a proportionate approach and preserve remedies required by law.

8. Responsibility & Legal Rights

We do not provide an on-site guide or control changing physical conditions. You remain responsible for decisions about your visit and for following lawful access requirements. We remain responsible for our own content, representations and digital service to the extent required by law. No clause in these terms releases all claims connected with a visit, caps every claim at the tour price, or removes duties that cannot lawfully be excluded.

Nothing here limits or excludes rights and remedies under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law. These terms are governed by New Zealand law.
