Self-Guided Activity Safety Information & Acknowledgement

This information applies when a What’s On Aotearoa offer expressly identifies a self-guided activity or an audio tour intended to be used at a physical location. Read the information for that particular location as well. A public listing of a place does not, by itself, grant access or make us its operator.

This document should be read with our General Terms & Conditions, the Audio Tours & Digital Content Terms where relevant, and any material conditions shown for the offer before purchase. A third-party activity may also have its provider’s own participation requirements, which should be provided before a booking is made.

1. What We Provide

Where we identify an audio tour as ours, we supply educational digital content for independent use. We do not provide an in-person guide, supervise your visit, monitor your location, assess your fitness, maintain tracks or land, or provide emergency or rescue services. An independent activity provider remains responsible for the service it supplies and its applicable safety duties.

We are responsible for our own content, statements and services to the extent required by law. Providing a route description or audio guide does not mean that we control the location or can observe conditions as they change.

2. Conditions & Risks

Outdoor and unsupervised locations may present hazards. Depending on the location, these can include uneven or slippery ground, unstable surfaces, rocks or falling debris, tides and changing water levels, weather, animals, vehicles and machinery, restricted access, limited mobile coverage and delays in receiving help. Some hazards are not marked or obvious and could cause serious injury.

This is a general list. Read and follow any warnings specific to the location or route, along with current signs, closure notices and instructions from the lawful land manager or activity provider. Conditions can change after content is created or updated. If conditions appear unsafe or access is closed, do not continue simply because a recording or map describes that route.

3. Your Decisions During a Visit

Before and during a visit, assess whether the conditions and activity are suitable for you and anyone in your care. Check relevant weather, tides, access notices and route conditions; take suitable clothing and supplies; supervise children and dependants; and stop or turn back when appropriate. Follow lawful signs and instructions. Do not operate a device in a way that distracts you while moving through a hazardous area.

In an emergency, contact emergency services on 111 in New Zealand if you can do so safely. We do not monitor use of digital content and cannot dispatch help.

These practical responsibilities do not transfer to you any legal duty that rests with us, a land manager or a third-party provider.

4. Land Access

An audio tour, map, listing or purchase does not itself give permission to enter private or restricted land. Access may be limited by opening hours, permission, weather, farming or other operations, conservation rules or temporary closures. Use only routes that are lawfully open to you and follow current instructions from the person or organisation responsible for the land.

If a route described in our content is closed or appears materially different from the description, do not enter it. Please tell us so that we can investigate and update the content where appropriate. If the location is essential to a paid digital product and cannot be accessed as described, contact us about the available remedy under the purchase terms and New Zealand law.

5. Information & Changes

We take reasonable care in preparing our own content, but we cannot continuously inspect or guarantee the current condition of land, weather, tracks, facilities or access. Providers may supply information for their own activities. We may correct, withdraw or update content when we learn that material information has changed. Do not rely on a historical description instead of a current official closure or safety notice.

Contact us if you identify an inaccurate route, access instruction or warning. Nothing in this section excuses inaccurate or misleading information supplied by us or removes a right to a remedy under applicable law.

6. Acknowledgement & Legal Rights

By purchasing or accessing a self-guided offer after this information has been presented to you, you acknowledge that no What’s On Aotearoa guide or on-site support is included unless the particular offer expressly states otherwise, and that conditions should be assessed at the time of your visit. This acknowledgement records the nature of the service and the practical precautions above. It is not a release of claims for injury or death, a general indemnity, or an agreement to waive consumer rights.

Nothing here limits any right or remedy under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable New Zealand law. Any responsibilities of an independent provider or land manager are determined by its actual role and the applicable law.
