This platform operates under What’s On Aotearoa, including its regional pages (including What’s On Ōamaru and other town-based pages).

By accessing the site, browsing listings, or purchasing any product or service, you confirm that you have read, understood, and agree to these Terms & Conditions.

1. About the Platform

What’s On Aotearoa operates a digital discovery, listing, and transaction facilitation platform across New Zealand.

Regional pages (including What’s On Ōamaru and future town pages) operate as branded divisions under the What’s On Aotearoa platform framework.

Depending on what you access or purchase, additional specific terms may apply. These additional terms form part of your agreement with us and are incorporated by reference.

2. Acceptance of Terms (Important)

By proceeding to purchase, access, or use any product or service on this platform, you acknowledge and agree that:

  • You have been given a reasonable opportunity to review these Terms & Conditions

  • You have reviewed any additional terms that apply to your purchase

  • Your continued use of the platform constitutes acceptance of these terms

(d) Business Listings & Vendor Participation
If you are a business listed on or participating through the platform, the Business Listings, Vendors & Commission Terms apply:

Some of the additional terms referred to above include acknowledgements of risk and responsibility for self-guided or outdoor activities. These acknowledgements form part of your agreement with us.

4. Platform Role & Scope of Responsibility

The platform does not:

  • Operate tours or attractions (unless expressly stated)

  • Supervise physical activities

  • Control land access or site conditions

  • Manage third-party staff or safety procedures

Our role is limited to:

  • Providing information and listings

  • Facilitating digital content access

  • Facilitating bookings and payments where applicable

Where bookings or payments are processed through the platform, we act as an intermediary facilitating the transaction between the customer and the relevant operator.

Responsibility for on-site delivery, safety, compliance, and service quality rests with the relevant operator or landowner.

5. Reliance on Information

Information on the platform is provided for general informational purposes only.

While reasonable care is taken:

  • Content may change

  • Conditions, availability, and access may vary

  • Event details may be updated by organisers

  • Information may not be current at the time of use

You are responsible for verifying details relevant to your decision before participating.

We aim to publish information, images, and other content from performers, event organisers, venues, vendors, and other official or authorised sources where reasonably possible.

Where content is supplied to us by a third party, that party is responsible for ensuring they have the necessary rights, licences, consents, and permissions to provide that content for publication.

If you believe that any content published on our platform is inaccurate, unauthorised, infringes copyright, or otherwise breaches your rights, please contact us promptly with the relevant details. We may investigate the matter and, where appropriate, amend, remove, disable access to, or suspend the relevant content while the issue is reviewed.

We may remove or suspend content at any time where we reasonably consider that there may be an accuracy issue, rights issue, legal risk, or breach of these Terms & Conditions.

6. Consumer Law (New Zealand)

Nothing in these Terms & Conditions limits or excludes any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, where those laws apply.

Where services are acquired in trade, contracting-out provisions may apply as set out in the relevant business-to-business terms.

7. Liability Framework

To the maximum extent permitted by law:

  • We are not liable for acts or omissions of third-party providers

  • We are not liable for personal injury, loss, or damage arising from self-guided or outdoor activities, except to the extent required by law

  • We are not responsible for environmental, weather, access, or site conditions

  • We are not liable for indirect or consequential loss

Liability relating to physical environments is addressed in the Self-Guided Activity Risk Acknowledgement.

Nothing in these terms excludes liability where exclusion is not permitted by law.

8. Intellectual Property, Website Use, and Content Restrictions

All content on the platform, including text, branding, images, audio content, digital materials, event listings, layout, and other website content, is protected by intellectual property laws and remains subject to applicable rights owned by us and/or our licensors, contributors, organisers, venues, vendors, or other relevant rights holders.

Unless expressly permitted by us in writing, you must not copy, reproduce, republish, scrape, harvest, crawl, download, frame, mirror, distribute, modify, adapt, extract, or otherwise use any part of this website or its content for commercial purposes or for republication on another website, platform, database, service, or publication.

You must not use any automated means, including bots, scripts, scrapers, spiders, crawlers, data mining tools, or similar technologies, to access, scrape, extract, collect, index, monitor, or reuse any content or data from this website without our prior written consent.
